Human Rights Country Report

  • Fiji – 2021 Report (966KB) – Fiji is a constitutional republic. In 2018 the country held general elections, which international observers deemed free, transparent, and credible. Josaia Voreqe (Frank) Bainimarama’s Fiji First party won 27 of 51 seats in parliament, and he began a second four-year term as prime minister.

Following legislative elections, the House of Assembly nominates three or four presidential candidates from among its members, and the public then elects the president for a four-year term. Citizens re-elected Taneti Maamau president in two-stage parliamentary and presidential elections in June 2020. Observers considered the elections to be free and fair, despite allegations of corruption and foreign influence throughout election campaigning.
  • Kiribati – 2020 Report (253 KB) – Kiribati is a constitutional multiparty republic. The president exercises executive authority. Following legislative elections, the House of Assembly nominates three or four presidential candidates from among its members, and the public then elects the president for a four-year term. Two-stage parliamentary elections in April preceded the June 22 presidential elections, in which citizens re-elected Taneti Maamau president. Observers considered the elections to be free and fair, despite allegations of corruption and foreign influence throughout election campaigning.

Observers considered the two-stage parliamentary elections held in December 2015 and January 2016 to be free and fair.

Observers considered parliamentary elections held in 2015 and January 2016 generally free and fair. Citizens elected Taneti Maamau president in March 2016. Observers considered this election free and fair.

The legislative assembly nominates at least three, and no more than four, presidential candidates from among its members. Observers considered parliamentary elections held on December 30, 2015, and January 7, 2016, generally free and fair. Citizens elected Taneti Maamau president on March 9. Observers considered this election free and fair.

The Legislative Assembly, a parliamentary body consisting of 17 popularly elected members and nine nobles selected by their peers, elects the prime minister. Following the November election, which international observers characterized as generally free and fair, then prime minister Pohiva Tu’i’onetoa removed himself from consideration for continuing in the position, and Siaosi Sovaleni was selected as new prime minister. While the prime minister and his cabinet are responsible for most government functions, King Tupou VI, the nobility, and their representatives retain significant authority.
  • Tonga – 2020 Report (179 KB) – The Kingdom of Tonga is a constitutional monarchy. The Legislative Assembly, a parliamentary body consisting of 17 popularly elected members and nine nobles selected by their peers, elects the prime minister. Following the 2017 election, which international observers characterized as generally free and fair, Prime Minister Samuela ‘Akilisi Pohiva was returned to office for a second term. After Pohiva’s death in September 2019, the Legislative Assembly elected Pohiva Tu’i’onetoa to replace him. While Tu’i’onetoa and his cabinet are responsible for most government functions, King Tupou VI, the nobility, and their representatives retain significant authority.

The Legislative Assembly, a parliamentary body consisting of 17 popularly elected members and nine nobles selected by their peers, elects the prime minister. Following the November 2017 election, which international observers characterized as generally free and fair, Prime Minister Samuela ‘Akilisi Pohiva was returned to office for a second term. After Pohiva’s death in September, the Legislative Assembly elected Pohiva Tu’i’onetoa to replace him. While Tu’i’onetoa and his cabinet are responsible for most government functions, King Tupou VI, the nobility, and their representatives retain significant authority.

While Pohiva and his cabinet are responsible for most government functions, King Tupou VI, the nobility, and their representatives retain significant authority.
  • Tonga – 2017 Report (PDF 80 KB) – The Kingdom of Tonga is a constitutional monarchy. King Tupou VI, popularly elected parliamentary leaders, the nobility and their representatives, prominent commoners, and democratic reform figures dominated political life. The most recent parliamentary election occurred on November 16. Observers characterized the election as generally free and fair. On December 18, parliament re-elected Samuela ‘Akilisi Pohiva to serve as prime minister.
  • Tonga – 2016 Report (PDF 82 KB) – The Kingdom of Tonga is a constitutional monarchy. King Tupou VI succeeded his older brother in 2012, and was formally crowned in 2015. The king, popularly elected parliamentary leaders, the nobility and their representatives, prominent commoners, and democratic reform figures dominated political life. Parliamentary elections, which observers characterized as generally free and fair, were held in 2014, and in 2014 parliament elected long-time supporter of democratic reform Samuela ‘Akilisi Pohiva as prime minister.

Observers judged parliamentary elections held in 2019 were free and fair, with seven new members elected to the 16-member parliament. There are no formal political parties. Following the elections, parliament selected Kausea Natano as prime minister.

Observers judged that parliamentary elections held in September 2019 were free and fair, with seven new members elected to the 16-member parliament. There are no formal political parties. International Religious Freedom Report

  • Fiji – 2021 Report – The constitution establishes a secular state and protects freedom of religion, conscience, and belief.  It also mandates the separation of religion and state.  The constitution prohibits discrimination based on religious affiliation, and laws make inciting hatred or “disaffection” against any religious group a criminal offense.   • Kiribati – 2021 Report – The constitution provides for freedom of religion.  Religious groups with memberships equal to or greater than 2 percent of the population are required to register with the government.  The government allowed the Kiribati Protestant Church (KPC) to operate, but the Church was not able to register during the year due to a court case and opposition to its registration from the Kiribati Uniting Church, according to KPC leadership.   • Nauru – 2021 Report – The constitution and other laws provide for freedom of conscience, thought, and religion, and for freedom to change one’s religion or beliefs.  Although the law requires registration for religious groups to conduct a full range of activities, religious groups stated they could conduct most normal functions without registration.   • Tonga – 2021 Report – The constitution grants freedom to practice, worship, and assemble for religious services.  The constitution requires the Sabbath, which the government defines as Sunday, be “kept holy” and prohibits most commercial transactions and many recreational activities on Sunday, except as permitted by law.   • Tuvalu – 2021 Report – The constitution provides for the freedom to change religion or belief and the freedom to show and spread religious belief through worship, teaching, observance, or practice.  The law designates the Ekalesia A Kelisiano Tuvalu (Congregational Christian Church of Tuvalu, or EKT) as the state church and allows it to conduct “special services on major national events.”  The powers of the ombudsman include oversight of a national human rights institution to promote and protect human rights, including religious freedom, and labor law prohibits discrimination on the basis of religion. Two islands in the southern part of the country continued to uphold a “one-church-only” policy due to a stated deference to the first Protestant missionaries that visited the islands in the 1800s.

Trafficking in Persons Report

  • Fiji – 2021 Report – The Government of Fiji does not fully meet the minimum standards for the elimination of trafficking but is making significant efforts to do so. The government demonstrated overall increasing efforts compared to the previous reporting period, considering the impact of the COVID-19 pandemic on its anti-trafficking capacity; therefore Fiji was upgraded to Tier 2.
  • Fiji – 2020 Report – The Government of Fiji does not fully meet the minimum standards for the elimination of trafficking but is making significant efforts to do so. These efforts included initiating a similar number of investigations compared to the previous year, increasing the number of officers assigned to the police human trafficking unit, designating an agency responsible for coordinating victim services, and convening the interagency working group on trafficking.
  • Fiji – 2019 Report – The Government of Fiji does not fully meet the minimum standards for the elimination of trafficking but is making significant efforts to do so. These efforts included the formalization of the police’s anti-trafficking unit, which will result in increased resources to investigate trafficking cases. Officials initiated prosecutions of two suspected labor traffickers, provided training for police officers, and conducted public awareness campaigns.
  • Tonga – 2021 Report – The Government of Tonga does not fully meet the minimum standards for the elimination of trafficking but is making significant efforts to do so. These efforts included training new police recruits on victim identification and trafficking investigations and continuing to provide funding to an NGO available to assist trafficking victims.

  • Fiji – 2014 Report – Fiji is a source country for women and children subjected to sex trafficking and forced labor, and a transit and destination country for Asian men and women subjected to forced labor and forced prostitution. Fijian women and children are trafficked abroad or in between cities for sexual exploitation and as domestic workers.
  • Kiribati – 2014 Report – Kiribati is a source country for girls subjected to sex trafficking within the country. Crew members, mainly South Korean men on foreign fishing vessels in Kiribati or in its territorial waters around Tarawa, exploit children. A local NGO has reported that as many as 50 I-Kiribati girls, some as young as 12, may be subjected to forced prostitution in local bars, hotels, and aboard vessels.
  • Tonga – 2014 Report – Tonga is a destination country for women subjected to sex trafficking and, to a lesser extent, a source country for women and children subjected to domestic sex trafficking and forced labor.
